Mining Lease Application Information

mining lease gives the holder the exclusive right to conduct mining operations and sell the minerals specified in the conditions attached to the lease. A mining lease must be obtained before the production or sale of minerals can commence and is the first stage in South Australia’s two-stage mining approvals process.
 
Mining leases can be granted to the holder of a mineral claim, a retention lease or an exploration licence. If a mining lease is granted, tenement holders will need to hold an approved PEPR before operations can commence.
 
The following will be required to successfully submit this application, please ensure you have met these requirements or have the required information before beginning:
  • Shape file defining the boundary of the Mining Lease Application area in the required coordinate system.
  • A plan showing the existing MC/RL/EL and the mining lease application area.
  • If the application area has been physically marked out with pegs, photos of each peg.
    • If the application area has been physically marked out with pegs, photos of each peg.
    • An agreement with any underlying tenement holders that meets the requirements of section 80(2) of the Mining Act 1971.
  • A copy of any required Notice of Entry to land and proof of service if they have not already been provided to the Mining Registrar or alternatively a copy of any required Notice of an Agreement to waive the requirement to serve a Notice of Entry if they have not already been provided to the Mining Registrar.
  • A Capital cost declaration.
  • A mining proposal that meets the requirements of section 36(1) of the Mining Act 1971, the Mining Regulations 2020 and the relevant Ministerial determination.
